NOTICE / ASSUMPTION OF RISK: Participation in this event and entry into the Santa photo area are voluntary. By entering, you and any children in your care assume all risks of attending and participating, including but not limited to crowds, lines, walking surfaces, weather conditions, props, décor, electrical cords, staging, and interaction with Santa or other performers.

RELEASE: To the fullest extent permitted by law, you agree to release and hold harmless the property owner/landlord, its affiliates, property manager, tenants, the City, event sponsors, organizers, Santa/performers, photographers, and each of their respective officers, employees, contractors, and agents (collectively, the “Released Parties”) from any claims for injury, illness, death, property loss, or damage arising out of or related to this event, except to the extent caused by the Released Parties’ gross negligence or willful misconduct.

PERSONAL PROPERTY: You are responsible for your personal property. The Released Parties are not responsible for lost, stolen, or damaged items.

INDEMNITY: You agree to indemnify and defend the Released Parties from claims brought by or on behalf of anyone in your group (including minors) arising from your or their acts or omissions during the event, to the fullest extent permitted by law.es here

HEALTH NOTICE: Attendance includes potential exposure to communicable illnesses. By entering, you acknowledge and accept this risk for yourself and any minors in your care. Please do not participate if you or a child are feeling ill.

PHOTOGRAPHY & VIDEO: Photos and/or video may be taken in and around this event area. By participating, you consent to being photographed/recorded and to the use of your likeness for personal, informational, promotional, or archival purposes by the Released Parties, without compensation.

EXPANDED GRANT OF RIGHTS: As Parent/Legal Guardian, you grant the Photographer and the Released Parties the irrevocable and perpetual right, license, and permission to use the photographs and/or video recordings of the minor child(ren) and any pets for commercial and non-commercial purposes, including but not limited to advertising, marketing, website, social media, promotional materials, and archival use, in all forms of media.

ALTERATION & COPYRIGHT: You authorize the Photographer to edit, crop, retouch, or alter the photographs without restriction. You waive the right to inspect or approve the finished product. The Photographer retains the copyright to all photographs.

BIOMETRIC DATA AND AI USE: You specifically consent to the use of the photographs and video recordings for the analysis, collection, and storage of facial geometry or other biometric data, and for use in training machine learning models or other artificial intelligence (AI) technologies. This includes enabling photo search functionality on the platform. This use is solely for the internal purposes of the Released Parties (e.g., photo sorting, security, or product development), without further compensation.

MINORS: A parent or legal guardian must be present and, by allowing a minor to participate, provides consent on the minor’s behalf and waives any claims for libel, defamation, or invasion of privacy related to the photo's use.

OPT-OUT: If you do not wish to be photographed or recorded, please notify staff before approaching Santa. We will make reasonable efforts to accommodate, but we cannot guarantee exclusion from wide-angle or crowd shots.

SUPERVISION REQUIRED: Children must remain under the direct supervision of a parent or legal guardian at all times. Parents/guardians are solely responsible for their children’s safety and behavior.

CONDUCT: Please follow staff instructions regarding lines, seating, and interaction with Santa and props. Unsafe or disruptive behavior may result in removal from the event area at staff discretion.

• No food or drinks on or near Santa’s chair or props.

• No climbing on Santa, his chair, staging, or decorations.

• Parents/guardians must place and remove small children from Santa’s chair.

• Please keep hands visible during photos.

• Notify staff of any sensory, medical, or mobility needs—we’re happy to assist and provide reasonable accommodations.

• Pet Owner Responsibility: The pet owner/guardian is solely responsible for the pet's actions, safety, and hygiene (including immediate waste cleanup) at all times while on the premises. Pets must be leashed or in a carrier until instructed otherwise by staff.

• Pet Indemnity: You agree to indemnify and defend the Released Parties from any and all claims, lawsuits, or damages (including property damage or injury to other participants/pets) caused by your pet.

• Removal: Unsafe, aggressive, or disruptive pets must be immediately removed from the event area upon staff request.
